Chapter 1 General Provisions

Article 2 (ID Holders)

Article 3 (ID Registration and Changes, etc.)

(3) Where the Company determines that the ID Holder has violated or is likely to violate these Terms

Article 4 (Prohibited Acts of ID Holders)

In using Mirairo ID services, ID Holders shall not engage in any of the following acts, or acts that the Company determines are likely to constitute the following:

(1) Acts that infringe the property, privacy, or similar interests of other ID Holders or third parties

(2) Acts that defame, annoy, or cause discomfort to other ID Holders or third parties

(3) When registering identity verification documents such as a disability certificate, any act that falsifies the identity between the person shown on the registered identity verification document and the ID Holder, including registering a third party’s identity verification document or registering a forged or false identity verification document

(4) Unauthorized access to computers such as the Company’s servers, or transmitting or posting harmful computer programs, harmful emails, or the like

(5) Acts linked to criminal conduct

(6) Acts that cause nuisance to the Company

(7) Other acts that violate or are likely to violate laws, ordinances, public order and morals, or these Terms

Article 5 (Responsibilities of the Company and ID Holders)

1. The Company assumes no responsibility whatsoever for the following damages arising from an ID Holder’s use of Mirairo ID (including, but not limited to, the items in this paragraph) or inability to use Mirairo ID (including, but not limited to, mental distress to the ID Holder or a third party, or other disadvantages including monetary loss), unless attributable to the Company. Even where the Company is liable, the Company’s liability shall be limited to direct and ordinary damages.

(1) Damages to ID Holders arising from unauthorized alteration of Mirairo ID, unauthorized access to data related to Mirairo ID, introduction of computer viruses, or other wrongful acts, despite the Company having taken reasonable security measures

(2) Damages to ID Holders arising from interruption, delay, suspension, or data loss of systems or services due to failures of communication lines or computers, or from unauthorized access

Article 6 (Handling of Personal Information)

Article 9 (Exclusion of Antisocial Forces)

1. ID Holders represent and warrant that they do not and will not fall under any of the following:

(1) Organized crime groups, members of organized crime groups, persons who have not ceased to be members of organized crime groups for five years, quasi-members of organized crime groups, companies related to organized crime groups, corporate extortionists (sokaiya), groups engaging in criminal activities under the pretext of social campaigns, special intelligence violent groups, or other persons equivalent thereto (collectively, “Organized Crime Group Members, etc.”)

Article 10 (Prohibition of Assignment of Rights and Obligations)

Article 11 (Governing Law and Jurisdiction)

These Terms shall be interpreted in accordance with the laws of Japan, and the Osaka District Court shall have exclusive agreed jurisdiction as the court of first instance for disputes relating to these Terms.

Chapter 2 Special Provisions on Mirairo Coupon Services

Article 12 (Scope of Application)

This Chapter applies to Mirairo Coupon services provided by the Company. Matters not provided for in this Chapter shall be governed by these Terms and all other rules separately established by the Company.

Article 13 (Content of Mirairo Coupon Services)

1. “Mirairo Coupon services” means services whereby information on various products and services that the Company has approved for listing (“Coupon Information”) is listed in display frames designated by the Company in Mirairo ID, and whereby ID Holders are issued coupons (“Coupons”) for purchasing or using such products or services with companies providing such products or services (“Listed Companies”). Coupons are issued by displaying the Coupon on the Mirairo ID app screen.

2. The content of Coupons, validity periods, conditions of use, and other terms shall be determined by Listed Companies in the Coupons. Among ID Holders, persons who use Coupons (“Coupon Users”) may use Coupons at their own responsibility after confirming such content each time they receive a Coupon.

Article 14 (Prohibited Acts)

Coupon Users shall not engage in the following acts when using Mirairo Coupon services:

(1) Assigning Coupons to third parties or creating security interests therein

(2) Using information including Coupon Information for purposes other than use of Mirairo Coupon services

(3) Republishing or reproducing information including Coupon Information externally

(4) Using Mirairo Coupon services by impersonating a third party

(5) Acts that infringe or are likely to infringe the rights or interests of the Company or third parties

(6) Violations of these Terms or any other rules established by the Company

(7) Use of Mirairo Coupon services by persons other than Mirairo ID holders

(8) Any other acts that the Company determines to be inappropriate

Article 15 (Response to Violations of These Terms)

1. If a Coupon User violates the provisions of these Terms, including this Chapter, the Company may, without prior notice, take any of the following measures against such Coupon User:

(1) Warn the Coupon User to cease the violation of these Terms

(2) Suspend use of Mirairo Coupon services

(3) Terminate Mirairo ID registration (the contractual relationship regarding Mirairo ID)

(4) Disclose the fact of the violation within or outside Mirairo Coupon services

2. The Company assumes no responsibility whatsoever, regardless of name or method including damages, for damage arising to Coupon Users as a result of taking the above measures.

Article 16 (Disclaimer)

1. With respect to Coupon Information listed in Mirairo Coupon services, the Company does not guarantee the accuracy, legality, or fitness for purpose of Coupon Information, or the absence of non-conformity with contract regarding such products and services.

2. Mirairo Coupon services are used by Coupon Users presenting Coupons to Listed Companies. Even if disputes or troubles arise between a Coupon User and a Listed Company regarding use of Coupons, the Company shall not be involved except where attributable to the Company, and such matters shall be resolved between the Coupon User and the Listed Company.
